Buying property in Kenya while living abroad can be an important financial and personal decision. For many members of the diaspora, property represents more than an investment — it may provide a connection to home, a future residence, family security or a source of income.

Start With the Purpose of the Property

Before searching listings, decide what you want the property to accomplish. Are you purchasing a future home, an apartment for visits, a long-term rental, a furnished investment or property for future development?

Your intended use should influence the location, property type, budget, management requirements and the level of return you expect.

Verify Ownership Independently

Do not rely solely on documents supplied by a seller, agent or developer. An independent Kenyan advocate should verify ownership and review the relevant title or lease records before substantial funds are committed.

The review should also identify registered charges, restrictions or other interests that may affect the property.

Use Your Own Advocate

Even when a developer or seller already has legal representatives, a diaspora buyer should consider engaging an independent advocate whose responsibility is specifically to the buyer.

The advocate can review the sale agreement, ownership information, transfer documents, consents and other completion requirements.

Confirm the Property Matches What Is Being Sold

Legal ownership is only one part of due diligence. Confirm the physical property, unit number, floor area, parking allocation, common areas and the services or amenities being represented.

If you cannot visit personally, arrange for an independent representative, surveyor, valuer or other qualified professional to inspect the property. A professionally recorded video inspection can also help a buyer abroad understand the property and surrounding neighborhood.

Understand the Total Cost

The advertised purchase price is not the complete cost of owning property. Depending on the transaction, additional costs may include professional fees, registration costs, applicable taxes, valuation expenses and other transaction charges.

Apartment ownership may also involve recurring expenses such as:

  • Service charges
  • Property management
  • Repairs and maintenance
  • Insurance
  • Utilities during vacancy
  • Furnishing and replacement costs

Investigate the Developer or Seller

For new and off-plan developments, research the developer's history. Look at completed projects, delivery record, construction quality and the legal ownership of the development site.

Marketing renderings and projected returns should never replace legal, financial and physical due diligence.

Be Careful With Payment Instructions

Long-distance buyers can be particularly vulnerable to payment fraud. Verify payment instructions through a trusted independent channel before transferring substantial funds.

If banking instructions unexpectedly change during a transaction, verify the change directly with your advocate or the relevant institution.

Think About Management Before You Buy

If the property will be rented while you live abroad, determine who will manage it before completing the purchase.

Ask who will:

  • Find and screen tenants
  • Collect rent
  • Handle repairs
  • Inspect the property
  • Coordinate emergencies
  • Provide income and expense reporting

Compare the Neighborhood, Not Just the Building

A beautiful apartment is only part of the investment decision. Consider access, competing developments, nearby employment centers, schools, hospitals, shopping and the type of resident the neighborhood attracts.

Keep Control of Your Records

Maintain your own complete transaction file containing agreements, searches, professional reports, receipts, payment confirmations, correspondence and ownership documentation.
